Wedly — Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of Wedly, a wedding website platform operated by The Meteor Labs SAC ("The Meteor Labs"), a company incorporated under the laws of Peru. By creating an account or using Wedly in any way, you agree to be bound by these Terms.

If you do not agree, please do not use Wedly.

2. Eligibility

You must be at least 16 years of age to use Wedly. By using the platform, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts found to be in violation.

3. Account Registration

To create a wedding website, you must register for an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us promptly of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Services

Wedly provides tools that allow couples to:

• Build and publish a public wedding website using templates and custom content
• Collect and manage guest RSVPs, including dietary and travel information
• Send notifications to guests and the host via email, WhatsApp, and SMS
• Upload and share photos and event details with guests

Wedly offers both a Free tier and paid subscription plans. Feature availability varies by plan. Pricing and plan details are available on our website.

5. Billing and Cancellation

• Wedly offers a Free plan with no credit card required.
• Paid plans are billed on a recurring basis. By subscribing, you authorize us to charge the payment method on file at the start of each billing cycle.
• You may cancel your subscription at any time via your account Settings. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods, except where required by applicable law.
• We reserve the right to change pricing with reasonable prior notice.

6. User Content

6.1 Ownership

You retain ownership of all content you upload to Wedly, including photos, text, and other materials ("User Content"). By uploading User Content, you grant Wedly a non-exclusive, worldwide, royalty-free license to host, display, and transmit that content solely to provide the service to you.

6.2 Content Standards

You agree not to upload or publish content that:

• Is unlawful, defamatory, obscene, or harmful to others
• Infringes any third party's intellectual property rights
• Contains viruses or malicious code
• Violates any person's privacy or publicity rights

6.3 Guest-Uploaded Photos

Guests may submit photos via the Photos tab of the wedding website. These photos are reviewed by the couple before being published. We reserve the right to remove content that violates these Terms.

7. Host Responsibilities for Guest Data

As a Host (host), you are the data controller for your guests' personal data collected through your Wedly wedding website. You are responsible for:

• Ensuring you have a lawful basis for collecting and processing guest data
• Informing guests that their data will be collected via the RSVP form and processed by Wedly
• Ensuring that companion data submitted on behalf of others is done with those individuals' knowledge
• Using guest data solely for the purpose of organizing and communicating about your wedding event

8. Notifications (WhatsApp / SMS / Email)

• Hosts may opt in to receive real-time notifications via WhatsApp or SMS to the phone number provided in Settings. Standard carrier rates may apply.
• Guests receive RSVP confirmation emails and QR ticket copies after completing an RSVP.
• You may opt out of SMS/WhatsApp notifications at any time via your account Settings.

9. Prohibited Uses

You agree not to use Wedly to:

• Violate any applicable law or regulation
• Impersonate any person or entity
• Harvest or collect data from other users without authorization
• Interfere with or disrupt the platform's infrastructure
• Attempt to gain unauthorized access to any part of the platform
• Use the platform for any commercial purpose other than organizing your own personal event

10. Intellectual Property

All platform software, designs, templates, branding, and proprietary content are owned by The Meteor Labs SAC and protected by applicable intellectual property laws. Nothing in these Terms grants you any rights in the Wedly platform beyond the limited right to use it as described herein.

11. Account Deletion and Data Removal

You may delete your account at any time via the Settings page. Upon deletion, your account data and all associated wedding website content will be permanently removed, including guest RSVP data. We may retain certain records for legal compliance, fraud prevention, or dispute resolution for a limited period following deletion.

12. Disclaimers

Wedly is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The platform will be uninterrupted or error-free
• Any defects will be corrected
• The platform is free of viruses or other harmful components

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

13. Limitation of Liability

To the maximum extent permitted by applicable law, The Meteor Labs SAC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Wedly, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or USD $100, whichever is greater.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Peru. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Lima, Peru.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by updating the effective date and, where appropriate, by notifying you via email or within the platform. Continued use of Wedly after changes take effect constitutes acceptance of the revised Terms.
