1. Agreement to Terms

By accessing or using Wedly (“the Service”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Wedly is a wedding website builder platform that allows users to create personalized wedding websites, manage RSVPs, and share information with their wedding guests. The Service includes web-based tools, templates, and features designed to help couples plan and communicate about their wedding events.

3. Account Registration

To use certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these terms or contain false information.

4. User Content

You retain ownership of all content you upload to Wedly, including photos, text, and other materials (“User Content”). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content solely for the purpose of providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to use and share your User Content
  • Your User Content does not infringe on any third-party rights
  • Your User Content complies with all applicable laws and regulations

5. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload harmful, offensive, or inappropriate content
  • Harass, abuse, or harm others
  • Distribute spam, malware, or malicious code
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Collect user information without consent
  • Use the Service for any commercial purpose without authorization

6. Subscription Plans and Payments

Wedly offers both free and paid subscription plans. For paid plans:

  • Billing: You will be billed in advance on a recurring basis (monthly or annually, depending on your plan).
  • Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
  • Price Changes:We may change prices with 30 days' notice. Continued use after price changes constitutes acceptance.
  • Refunds: Refunds are provided at our discretion. Contact support for refund requests.

7. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • You will retain access to paid features until the end of your current billing period
  • Your wedding website will remain accessible but may be limited to free plan features
  • You can export your data before cancellation

8. Intellectual Property

The Service, including its original content (excluding User Content), features, and functionality, is owned by Wedly and is protected by copyright, trademark, and other intellectual property laws. Our templates, designs, logos, and branding are proprietary and may not be copied, modified, or distributed without permission.

9. Third-Party Services

The Service may contain links to or integrations with third-party websites, services, or applications. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to their terms.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEDLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Wedly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wedly operates, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
